This document stipulates the terms and conditions for the daycare photography services between Whippersnappers Photography and the Client as per the booking form.
The Session
The photography session will last for the agreed period of time. During the session, employees of the Client organisation will be made available to aid in identifying the correct children as per the sitting list and ensuring that children’s faces are clean and presentable. The employees will also be responsible for organising any group photos at the nominated times. The photographer will take candid photos where possible, but posed photos may be required at times eg groups of people.
The Sittings
The Client organisation is responsible for advertising the photo day and for distribution of information via an email which will be provided by Whippersnappers Photography. All orders are to be received by the stipulated order cut off date to be included in the sessions on the day. Late order forms will be available on the day, it is the responsibility of the Client to ensure late order forms are handed to the photographer in a timely manner to ensure the orders are able to be completed.
The Product
The participants in the photo day must choose a package and make payment for the package prior to ensure that their child is photographed on the day. All photos will be printed in colour unless the package indicate there is a choice between colour or black and white.
The Images
The photography copyright always remains the property of Whippersnappers Photography. Whippersnappers Photography has exclusive rights to use images for any marketing & publicity purpose, competitions, exhibitions or editorial use. No other party is granted the right to reproduce or use the photos without specific approval.
Photo Permissions
Whippersnappers gains permission to take each child’s photo and for inclusion on their group photo via the individual’s order form (online or late). Where a Client has requested room group photos EVERY CHILD who has not placed an order MUST HAVE permission to have their photo taken. This is the responsibility of the Client. If the Client’s policies and procedures allow for the photo permissions on a child’s enrolment form to be used for external photography then this permission will suffice. If it does not, the Client must ensure that each child in attendance has been given permission to be included in their group photo.
Limits of Liability
If Whippersnappers Photography cannot perform this agreement in whole or in part due to circumstances beyond the control of the parties or due to the photographer’s illness or injury, then Whippersnappers Photography will return all money to the client(s) or offer an alternative date for another session but shall have no further liability with respect to this agreement.
This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of photographer.
It is the responsibility of the Client to ensure the safety of themselves and their children while on the property at which the photo day is taking place.
Whippersnappers Photography is competent to perform & complete this assignment.
